Dispelling Bankruptcy Myths

· Myth #1: Because of the new law, I can't file for bankruptcy.
Truth:
Yes, you can. Although the new bankruptcy law enacted in 2005 made bankruptcy more difficult (essentially, it added "more hoops"), anyone who was eligible for bankruptcy before the new law is still eligible today. The law did not cause a decrease in the number of consumer bankruptcies.

· Myth #2: I can't discharge a final civil judgment.
Truth:
Yes, you can. If a judge orders you to repay someone for services rendered or goods delivered, that debt is dischargeable under bankruptcy. The only exception is if you incurred the debt through fraud.

If you are trapped under a mountain of debt and can't afford to pay it back; if your interest is growing faster than you can make payments; if your creditors keep hounding you to pay them back — you should consider filing for bankruptcy. At James H. Monroe, P.A., well help clients file for Chapter 7, Chapter 11 and Chapter 13 bankruptcy.
