  • Do not accumulate credit card debt before you file bankruptcy. If you do so, the bankruptcy court may view your actions as an attempt to exploit the bankruptcy system. You may face repercussions as a result.
  • Do not pay your friends or relatives, and do not attempt to transfer property to them in an attempt to save your property. If this happens, your friends or relatives may be sued.
  • Do not try to sell your property for less than it is worth. The buyer may end up having to pay the difference.
  • Do not buy expensive luxury items before you file bankruptcy. You will be held financially accountable for any items purchased within 70 days of the bankruptcy.
  • Do not take a cash advance from your credit card before you file for bankruptcy. The bankruptcy court may view this as an exploitative effort and may not discharge the debt as a result.

Bankruptcy Do's

  • Do take your bankruptcy filing seriously. Be aware that the financial decisions you make now will be considered by the bankruptcy court, so do not take any actions that may appear as fraudulent or questionable.
  • Do seek representation from a bankruptcy lawyer, preferably before any papers are filed. This will ensure that the process is completed in accordance with the U.S. Bankruptcy Code.
